Katzman, Wylupek LLP

Estate Litigation Lawyer, Windsor, Ontario

As estate matters can be full of financial pitfalls, it is important to know whether you or your children have a valid claim to assets in an estate before you bring a dispute.  On the other hand, you may miss your chance to object to an estate trustee’s actions if you do not act quickly.  If a trustee is taking money that does not belong to them, it may already be too late.  For these reasons, it is important to receive good legal advice as soon as possible.

Eric Katzman is an experienced lawyer at Katzman, Wylupek LLP who can help with estate litigation matters.  Unlike most other estate litigators, Eric is willing to take cases on contingency.  This means that he will generally not charge a fee unless and until he is successful.  The contingency fee will be a percentage of what is won for a beneficiary or dependent.  Hourly options are also available.

No-obligation, confidential initial meetings with Eric are completely free.

Below are common questions that clients may have:

Are there strict time limits in estate matters?

Yes, there are several significant time limits.  If you wait, your case may become damaged.

What if I am not named in the will?

If you are a spouse, former spouse, or minor child of the deceased, you may be considered a dependent of the deceased.  You may be able to make a claim even if you are not named in the will.

I think that I would have done better in divorce than I can under the will.  Is this okay?

No.  You can make an election to receive what you would have gotten in divorce instead of what you are given in a will.

There is a will, but it was drafted under suspicious circumstances.  What should I do?

The will may not be valid and can be challenged.

Will the estate matter become contentious if I stand up for myself?

Not necessarily.  Sometimes litigation involves quickly clarifying an issue or fixing an omission in a will.  The problem may be with the will and not the people involved.  Eric handles matters sensitively and respectfully.
